Terms of Service

These terms govern your access to and use of the HailTrigger website and service.

These Terms of Service (the “Terms”) are a legal agreement between you and Retrolection LLC (“HailTrigger,” “we,” “us”). By accessing https://hailtrigger.com, creating an account, or using the service (collectively, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

The Service is a business tool intended for roofing contractors and their authorized staff. You must be at least 18 years old and able to form a binding contract. By using the Service you represent that you are using it for business purposes on behalf of an organization you are authorized to bind.

2. Accounts

You are responsible for the activity under your account and for keeping your credentials secure. Notify us promptly at support@hailtrigger.com of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that create risk for us, other customers, or message recipients.

3. Your data and the data you process

You retain ownership of the property, contact, and campaign data you upload or generate through the Service. You grant us a limited license to host and process that data solely to provide the Service. Our handling of personal information is described in our Privacy Policy.

4. Your compliance responsibilities (outbound messaging, calling, and mail)

The Service lets you send communications — including SMS text messages, calls, and mail — to consumers. You are solely responsible for the legality of every message you send and for obtaining any consent the law requires. This includes, without limitation:

  • the Telephone Consumer Protection Act (TCPA) and any required prior express (or prior express written) consent for marketing texts and calls;
  • carrier and CTIA messaging rules, including A2P 10DLC brand and campaign registration for your sending numbers;
  • state and federal Do-Not-Call rules, calling-time and quiet-hours restrictions, and honoring opt-out (STOP) requests; and
  • truthful, non-deceptive content and accurate sender identification.

The Service provides operational tooling (for example, suppression scrubs, opt-out handling, and quiet-hours controls) to help you operate responsibly, but those tools do not constitute legal advice and do not guarantee compliance. You bear all liability arising from your communications. You agree to indemnify and hold us harmless from claims arising out of your messaging, calling, mailing, or data-collection practices.

5. Acceptable use

You agree not to use the Service to:

  • send unlawful, harassing, deceptive, or fraudulent communications;
  • message recipients who have opted out or who you have no lawful basis to contact;
  • infringe intellectual property or privacy rights; or
  • interfere with, scrape, reverse engineer, or circumvent the security of the Service.

6. Fees

Paid features are billed as described at sign-up or in your order. Usage-based charges (including messaging, mail, and data-enrichment costs) are your responsibility. Fees are non-refundable except where required by law.

7. Intellectual property

The Service, including its software, design, and content (excluding your data), is owned by HailTrigger and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any lead, storm, or property data is accurate or complete.

9. Limitation of liability

To the maximum extent permitted by law, HailTrigger will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from or related to the Service or your communications. Our total liability for any claim will not exceed the amounts you paid us for the Service in the twelve months before the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to protect the Service or others. Sections that by their nature should survive termination (including 4, 8, 9, and 11) will survive.

11. Governing law

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless applicable law requires otherwise.

12. Changes

We may update these Terms. Material changes will be reflected by the “Last updated” date above and, where appropriate, by additional notice. Continued use after changes take effect constitutes acceptance.
